In a November 21 letter to Robert Scarano, DOB Borough Commish Magdi Mossad wrote, “Our inspection revealed a number of issues throughout the building that must be addressed prior to any renewal odf the issued T.C.O.” According to a tipster though, while Mossad was on vacation last week, developer Isaac Fischman mysteriously got the T.C.O. renewed, despite outstanding conditions like the unfinished outdoor balconies that we hear are leaking water into some of the units. Meanwhile, purchasers are being told to close as soon as this week! The whole thing stinks to high heaven. Any buyers out there know more about what’s happening? What’s the status of the mezzanines?

  1. leakage around all the balcony doors , around windows, on sills, from the ceilings resulting in huge damage to the wooden flooring. people have seen the leakage and have photos and a movie of it.

  2. All I can say is, I was about to enter into contract to purchase one of those mezzanine apartments on the fifth floor more than two years ago when the project first started. I am so glad that I did not go through with the transaction. I ended up purchasing instead a whole brownstone in Bed Stuy for less than the cost of the apartment (go figure!!). Not only will I have a fully renovated duplex (w/ cellar), but I also have two newly renovated apartments for rent, which will defray the cost a good portion of my mortgage. As far as I am concerned, I did pretty well and I will not have to deal with the “density” issues that the AY will bring (except w/ respect to parking). I know that some of you Brownstoner faithful are not fans of the Stuy for a multitude of reasons (some of which are valid and others of which are due to a lack of understanding), but for a young single guy in his early thirties with no kids, I got nothing but time to see my home/investment rise in value and to collect those rent checks.

  3. Threats and speculation aside, can’t commish Mossad simply WITHDRAWAL the tco if it was in fact illegally obtained via nefarious means?

    I can’t imagine that one could get away with something described such as this.

    No way would I close…There must be a way to recoup the money put down.

  4. There is one thing I don’t understand here – how come you people are so well informed about the letter Mossad sent to Scarano as to even quote it word-to-word? Who gave you this letter? At the same time, though, you are not so well informed about the leakage from the balconies, because you “hear” there is a leakage, but not quite sure. How do you even know this was the couse for the Mossad letter? Don’t you think you exagerate?
