i appreciate your loyalty, but geez...
no loyalty whatsoever, in fact i detest both of them - i just think that a handrail will take away the castle feel, not the crap smell though

i know the developer (personally) and the architect (by reputation), both pretty crappy... however i suspect that this building may look slightly better (or less ugly) once the handrails are in place, giving the parapet a cleaner finish... then again it may not

i looked into DOB's website - http://a810-bisweb.nyc.gov/bisweb/COApplicationSummaryServlet?requestid=3&passjobnumber=301752388&passdocnumber=01&allisn=0000958784&allbin=3058364 - and they do have a TCO issued, so it's ok, but in my experience no bank will issue a mortage without a final CO (unlike a few yrs ago, when anything was ok)

Corcoran listed a couple of them asking a $4500 and $5k rent, dunno if they got that much thou...
but, no CO = no loan from a bank = tough times selling

the bldg looks fine zoning wise... the left portion at the 'Attic' or 5th floor level is a permitted obstruction in the front setback since the zoning law considers it a Dormer.
the only reason i could think that they called the top level an attic is that they may be trying to get away with providing an elevator

According to Zoning section 23-62 lists Permitted Obstructions to the maximum building heights - it reads:
"In all #Residence Districts#, except as provided in Section 23-621 (Permitted obstructions in certain districts), the following shall not be considered obstructions and may thus penetrate a maximum height limit or #front# or #rear sky exposure planes# set forth in Sections 23-63 (Maximum Height of Walls and Required Setbacks), 23-64 (Alternate Front Setbacks) or 23-69 (Special Height Limitations): ...
...(d) Elevators or stair bulkhead, roof water tanks or cooling towers (including enclosures), each having an #aggregate width of street walls# equal to not more than 30 feet.
However, the product, in square feet, of the #aggregate width of street walls# of such obstructions facing each #street# frontage, times their average height, in feet, shall not exceed a figure equal to four times the width, in feet, of the #street wall# of the #building# facing such frontage;..."
So whether or not these bulkheads are allowed depends on their size as described - technically a calculation of some sort must be shown in the approved plans.
Also there is such a thing as a questionable layout – so if they look too big to be just bulkheads the plan examiner at the building department can and should issue an objection and then the architect would have to get reconsideration from a higher up to have them approved.

They better hurry up, not only might they loose their tax abatement, but after 1 year of a inactivity a DOB filing must be reinstated, and after 2 you can no longer reinstate the job, and must file it all over again. This approval will be no good after 11/23/2007.
