Can I move in to my house?!

We areconverting a 2 family house to a 1 family house. HOWEVER, because we added on more then 50%, the DOB made us file as a “New Building”. The house is livable now and Im wonderingif I can legally occupy the place? My expediter is telling us to move in and the Chief Plan Examiner at Brooklyn DOB told us months ago that we can live there….but it seems fishy to me to live there with out the new C of O or final construction sign off. Its a strange situation as it was a 50% addition but we were to file as a New Building. Does anyone have any further advice?

You certainly do NOT need a C of O to occupy your own home, especially if you are in the process of renovating.  As for the construction sign-off, our clients almost always move in before the final inspection so they don’t have to carry two mortgages, and I have never seen the DOB give them any trouble for it.

I thought owners are always allowed to have a “caretaker” in the building whether there’s a C of O or not – and presumably you could designate yourself as “caretaker”…

As far as your conversion, when you alter the living spaces YES you have to file a new C of O. and Yes you will need an official sign off on the construction before reoccupying your home
