House being taxed as a 3 family + high assessment roll
Hello, the Department of Finance has been taxing a home I will be closing on in a few weeks as a C0-WALK-UP APARTMENT (3-family house) when in reality it is a 2 family. Additionally, the new Tentative Assessment Roll has the estimated value 20% above the appraisal. Here are my 3 questions: 1 – What is the process of converting it from a 3-family to a 2-family? 2 – Will adjusting it from a 3-family to a 2-family lower my tax bill? 2 – How do you recommend I go about getting the Assessment Roll adjusted? Not sure, we did it by ourselves to no success. It appeared that like all of NYC property related depts, having a professional who’s done the rounds here could make more headway.

@mozeeatupu what do you advise? it appears that other houses on the block with similar square footage, c of o and better condition are paying much less. i dont understand the discrepancy is coming in. on what basis would you advise on contesting?

Go to NYC website to find seminars on challenging assessments & taxes – usually some time in Feb. in each borough. They’re very helpful.

None that I am aware of. I agree 1,200 isnt that much but its over 35% of what other folks are paying.

Was there some permitted work done to your house? Thay might be the reason your taxes are higher than others. All in all, it’s not a large amount

Thanks for that information. What I find strange is all the comps on the block have a much lower billable assessed value. The difference between my (to be) property and the others on the block equate to me paying $1,000 – $1,200 more a year in property taxes.

There is no difference in how taxes are calculated between three-families and two-families. The difference is between 1-3 and 4+. Also, since the increase in taxes is capped from year to year, usually the taxes are capped much lower than they would be based on your assessment. So effectively the valuation doesn’t make much of an impact on your taxes. Also, there’s no rule that the tax valuation has to be similar to your appraisal, and the sale price will have no impact on the tax valuation. So if your taxes are capped lower than your assessment, there’s no point in challenging the assessment. All that said, you can challenge your assessment during a certain period each year. If the difference is really crazy you might be able to get a lawyer to do it, but I recommend just doing more research and doing it yourself.
