Property tax challenge/tax certiorari law firm
Does anyone have a recommendation of a law firm that specializes in challenging property tax assessments (tax certiorari) for a single family home?

The Tax Commission can reduce your property’s assessment, change its tax class, and adjust exemptions. Before filing with the Tax Commission, look at your Notice of Property Value (NOPV) and see if it has a line called ”Effective Market Value”. You must prove that your current market value is less than the Effective Market Value for you to win your Tax Commission appeal…”

The market value is well above my (3-family) building’s worth, but my Effective Market value, like so many people, is a lot lower (than actual market). I was told by a certiorari lawyer not to bother since any reduction in Market Value to a number still higher than the Effective Market Value would not impact my taxes — and the chance of a reduction of that magnitude was slim. Is that consistent with other advice others have received or will the Effective Market Value go down proportionately with a cut in the Market Value? Is there a link to the seminar Arkady mentioned? small potatoes – do it yourself. i don’t think any certiorari would get out of bed for a percentage of that low amount given that property taxes in nyc are so low.

I tried 3 last year & the building I was appealing for was deemed not worth it by all of them. It’s a residential/commercial space that’s taxed at roughly $38,000 a year to give you a clue. It takes a lot of work to diy but it is doable. I have no business, financial nor legal background but got help at the seminar the City offered & from a friend who is a retired lawyer. I had a minor success.

In my opinion and experience, you are better off doing it yourself. But of course it does depend on why you are challenging it. If it is due to a huge capital improvement increase; it would not hurt to hire a lawyer. But there will not be much that can be done based on how the work was filed at the buildings department. If it is because you are taxed in the wrong class, or your taxes are much higher than other property on your block in the same class, do your home work and do it yourself, you will get a better outcome than using an attorney.
